About Flatly

Flatly is a community-driven mobile app published by Maxime Huot ("the Publisher"), whose contact details are available in Article 14.

Flatly lets current and former tenants — or anyone who has visited a rental property in Île-de-France — post anonymous reviews on specific addresses, helping prospective renters make informed decisions before signing a lease.

Reading reviews is free and requires no account. Publishing a review requires creating an account.

Acceptance of Terms

Using the Flatly app (the "Service") constitutes full and unreserved acceptance of these Terms of Use.

By creating an account or posting a review, you confirm that you have read, understood, and accepted these Terms without reservation.

If you do not agree to these Terms, please do not use the Service.

Access to the Service

The Flatly app is available free of charge on iOS and Android. All published reviews can be read freely without an account.

The Publisher reserves the right to restrict, suspend, or discontinue access to the Service at any time — for example for maintenance, security, or technical reasons — without this giving rise to any right to compensation.

Creating an Account

To post a review, ask a question, or vote, you must create an account using a valid email address and password.

You agree to:

  • Provide accurate information and keep it up to date;
  • Not create an account on behalf of someone else without their consent;
  • Not create multiple accounts to circumvent restrictions;
  • Keep your login credentials confidential.

Each account is personal and non-transferable. You are responsible for all activity that occurs under your account.

Review Publishing Rules

5.1 Authenticity is mandatory

In accordance with French law (including Decree no. 2017-1436 of 4 October 2017 on online review transparency), every review published on Flatly must be genuine, sincere, and based on a real personal experience at the property in question.

By ticking the certification checkbox when submitting a review, you declare on your honour that you have personally lived in or visited the property, in accordance with the French ELAN Act of 23 November 2018.

5.2 Prohibited content

You may not publish a review that contains:

  • Defamatory, abusive, racist, sexist, or discriminatory content;
  • Personally identifiable information about individuals (names, personal addresses, phone numbers);
  • Manifestly false or misleading statements;
  • Advertising or promotional content;
  • Any content contrary to public order or common decency.

5.3 One review per property

Only one review per property per user is allowed. A review may be edited before final publication.

5.4 Anonymity

Reviews are published anonymously. Your identity is never publicly disclosed. The Publisher retains identification information for moderation and legal compliance purposes only.

Moderation

Every submitted review undergoes manual moderation before publication. The Publisher reserves the right to reject or remove any review that violates these Terms.

If a review is rejected, you will be notified by email with the reason and the option to edit and resubmit.

Possible rejection reasons include: defamatory content, off-topic content, inauthentic review, insufficient detail, or non-compliance with these Terms.

The Publisher is not responsible for the content of published reviews, but commits to handling reports within a reasonable timeframe.

Landlord Right of Reply

Anyone declaring themselves to be the owner of a reviewed property may submit a public reply via the Service.

Replies are subject to the same content rules as reviews (Article 5.2) and undergo moderation before publication. They are displayed with the label "Declared owner · unverified", as Flatly does not verify ownership status.

The right of reply does not entitle anyone to demand the removal of a genuine review that complies with these Terms.

Intellectual Property

The Flatly brand, logo, design, and all elements of the app are the exclusive property of the Publisher and are protected by intellectual property law.

By publishing a review, you grant the Publisher a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, and display that content within the Service.

You warrant that you are the author of any content you submit and that it does not infringe the rights of any third party.

Liability

Flatly is a platform hosting user-generated content. As such, the Publisher benefits from the limited liability regime provided by French law (Law no. 2004-575 of 21 June 2004 on confidence in the digital economy — LCEN).

The Publisher does not guarantee the completeness, accuracy, or reliability of published reviews. Information on Flatly does not constitute professional advice (legal, financial, or otherwise) and cannot replace a physical visit to the property.

The Publisher is not liable for any decisions made by users based on published reviews.

Personal Data

The processing of your personal data is governed by the Flatly Privacy Policy, available at flatly.fr/en/privacy.html.

In accordance with the GDPR, you have rights of access, rectification, deletion, and portability regarding your data. You may exercise these rights by contacting hello@flatly.fr.

Suspension and Termination

You may delete your account at any time from within the app settings. Deletion results in the erasure of your personal data in accordance with the Privacy Policy.

The Publisher reserves the right to suspend or delete any account that violates these Terms — including repeated posting of prohibited content or fraudulent behaviour — without notice or compensation.

Changes to These Terms

The Publisher reserves the right to update these Terms at any time. Changes take effect upon publication in the app and on the website.

For material changes, registered users will be notified by email with 30 days' notice. Continued use of the Service after this period constitutes acceptance of the updated Terms.

Governing Law and Disputes

These Terms are governed by French law.

In the event of a dispute, the parties agree to seek an amicable resolution before taking legal action. Failing that, the courts of Paris shall have exclusive jurisdiction.

As required by European consumer law, users may also refer unresolved disputes to a free certified consumer mediator.
